KC WFC, LLC, KC WFC StadCo, LLC, KC WFC StadCo Funding, LLC, LSE Management, LLC and their affiliates (collectively, Current”, “we”, “us” and “our”) respect your privacy and are committed to protecting it through our compliance with this policy.

This privacy policy describes the types of information we may collect from you or that you may provide in connection with our interactions with you and through our products, services, games, events and programs – including our websites (including but not limited to https://www.kansascitycurrent.com/, https://cpkcstadium.com/ and https://teamstore.kansascitycurrent.com/) , apps (including but not limited to the Kansas City Current mobile application), and digital platforms (each, a “Site” and collectively, the “Sites”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information collected by or on behalf of KC Current:

  • On or through the Sites;
  • In email, text, and other electronic messages between you and the Sites; and
  • Through mobile and desktop applications you download from a Site, which provide dedicated non-browser-based interaction between you and such Site.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by the KC Current or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through a Site.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Sites. By accessing or using a Site, you agree to this privacy policy. This policy may change from time to time. Your continued use of a Site after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. Children Under the Age of 13
Our Sites are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on a Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. 2. Information We Collect About You and How We Collect It
We collect several types of information from and about users of our Sites, including:

  • Information by which you may be personally identified, such as name, postal address, email address, telephone number, your birthdate or any other identifier by which you may be contacted online or offline, such as a username, (“personal information”);
  • Information that is about you but individually does not identify you, such as your gender or your age;
  • Your business information (e.g., company, title, mailing address, email address, telephone number, facsimile number, tax ID number); and/or
  • Information about your internet connection, the equipment you use to access our Site(s), and usage details.

We collect this information:

  • Directly from you when you provide it to us;
  • Automatically as you navigate through the site (Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies); and
  • From third parties (e.g., our business partners).

A. Information You Provide to Us
The information we collect on or through our Sites may include:

  • Information that you provide by filling in forms on a Site (This includes information provided at the time of registering to use our Site, subscribing to a service, posting material, making inquiries or requesting further services);
  • Your login information for a Site (e.g., username, password, security questions and answers);
  • Your electronic signature;
  • Information when you enter a contest or promotion sponsored by us or a partner;
  • Information you provide when you report a problem with our Site;
  • Records and copies of your correspondence (including email addresses), if you contact us;
  • Your responses to surveys that we might ask you to complete for research or customer service purposes;
  • Details of transactions you carry out through our Site and of the fulfillment of your orders (You may be required to provide financial information before placing an order through our Site);
  • Your search queries on the Site;
  • Information related to your preferred content for automated updates and newsletters;
  • Information related to your event rental application (e.g., your organization name and contact information, the name of your event, space required, date and duration of your event, estimated attendance, ticket prices, sponsors, promoters, performers);
  • Information about third-parties that you refer to us (e.g., name, email and/or other contact information, relationship);
  • Information set forth in your online account registration, user profile, and/or user directory forms for a Site, if any;
  • Statements or content (e.g., comments, videos, photographs, images), and information about such statements or content, which you submit or publish on or through a Site, or which are accessed via your public or linked social media pages (e.g., Facebook, Twitter, Instagram); and/or
  • Your feedback on your experience at KC Current events (including comment/issue type, your contact information, the date of your event, your seat location, and your general comments/guest issues).

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages and you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

B. Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Site(s), we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Site, including traffic data, location data, logs and other communication data and the resources that you access and use on the Site.
  • Your computer, mobile device, and/or browser information (e.g., IP address, mobile device ID information, operating system, connection speed, bandwidth, browser type, referring/exit web pages, web page requests, cookie information, hardware attributes, software attributes);
  • Third-party website, network, platform, server and/or application information (e.g., Facebook, Twitter, Instagram, Ticketmaster);
  • Usage activity concerning your interactions with a Site and/or third-party websites, networks, platforms, servers or applications accessed through a Site (e.g., how you accessed a Site, where you go when you leave a Site, number of clicks on a page or feature, amount of time spent on a Site or a page or feature, identity of third-party websites, networks, platforms, servers and applications accessed through a Site); and/or
  • Usage activity concerning products and services provided to or accessed by you on or through a Site (e.g., number of viewers, viewing habits, viewing preferences, viewing history, title selections, favorites, streams, downloads, demographics and closed captioning selections).

The information we collect automatically is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Site and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Site according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to our Site.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Site. Pages of our Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the KC Current, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
  • Flash Cookies. Certain features of our Site may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies.

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources, or you provide to us.

C. Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

3. How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Site and its contents to you;
  • To facilitate your use or movement through a Site;
  • To provide you with information, products, or services that you request from us;

  • To help personalize user experiences with a Site and/or its products and services;

  • Conduct research and measurement activities for purposes of product and service research and development, advertising claim substantiation, market research, and other activities related to us, our affiliated companies, a Site and/or their respective products and/or services;

  • Protect or enforce our and/or our affiliated companies’ respective rights and properties;

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

  • For any other purpose with your consent.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

4. Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our employees, agents and administrators, accountants, financial advisors, legal advisors and affiliates;
  • To our sponsors;
  • To service providers, contractors and other third-parties that help us provide, manage, administer, maintain, monitor, distribute, operate or facilitate a Site, who help us develop, market or provide our products and services, or who help further our business efforts (e.g., web hosting companies, website administrators, support services companies, data analysis companies, credit card or other payment processing companies, television service providers or affiliates), as needed in order for them to perform such services;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of KC Current’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by KC Current about our Site users is among the assets transferred;
  • To third parties to market their products or services to you if you have consented to/not opted out of these disclosures;
  • To fulfill the purpose for which you provide it (e.g., if you give us an email address as part of an “email a friend” campaign, we will transmit the contents of that email and your email address to the recipients);
  • For any other purpose disclosed by us when you provide the information; and/or
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any law enforcement, government or regulatory request;
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; and/or
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of KC Current, our customers or others (which may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction).

5. Transactions.
In connection with any transaction that you conduct on, through or in relation to a Site, you may be asked to supply certain information relevant to the transaction, including, without limitation, your credit card number and expiration date, your billing address, your shipping address, your phone number and/or your email address. Collection and processing of such information may be handled by a third-party vendor. If so, you should consult the applicable vendor’s Terms of Service and Privacy Policy. To the extent you submit such information to us, by submitting such information, you grant us the irrevocable, unencumbered, universe-wide and perpetual right to provide such information to third parties (e.g., payment processing companies, online shopping cart providers) for the purpose of facilitating the transaction.

6. Accessing and Correcting Your Information.
You can review and change your personal information by sending us an email at info@kansascitycurrent.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Site, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Site users. Residents of certain states, such as California, Nevada, Colorado, Virginia and Utah may have additional personal information rights and choices. 7. Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

A. Your California Privacy Rights
If you are a resident of the State of California and we have an established business relationship with you, then, pursuant to Section 1798.83 of the California Civil Code, you have the right to request the following at any time: (a) information from KC Current free of charge regarding the manner in which we share certain personal information collected through the Site with third-parties who use such information for direct marketing purposes; and (b) the discontinuation (or opt-out) of our sharing of such information with such third-parties. Please submit any such request (“California Privacy Rights Request”) to info@kansascitycurrent.com with a subject line of “My California Privacy Rights” and clearly state the following in the body of the email:

  • the nature of your request;
  • the specific Site that is/are the subject of your request;
  • that the request is related to your California Privacy Rights;
  • your name, street address, city, state, zip code and email address; and
  • whether you prefer to receive a response to your request by mail or email.

We are not responsible for a California Privacy Rights Request that is incomplete, incorrectly labeled or incorrectly sent. You are solely responsible for the accuracy and content of your personal information, and for keeping your personal information current and correct. Further, We do not respond to “do not track” (DNT) signals.

B. Your Colorado, Connecticut, Virginia or Utah Privacy Rights
Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information;
  • Access and delete certain personal information;
  • Data portability; and
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose and
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

If you are resident of one of these states and wish to exercise any of these rights, please email info@kansascitycurrent.com with a subject line of “My State Privacy Rights” and clearly state the following in the body of the email:

  • the nature of your request;
  • the specific Site that is/are the subject of your request;
  • that the request is related to your State Privacy Rights;
  • your name, street address, city, state, zip code and email address; and
  • whether you prefer to receive a response to your request by mail or email.

To appeal a decision regarding a state consumer rights request, please email info@kansascitycurrent.com with a subject line of “Appeal” and the details of your appeal request.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request by emailing info@kansascitycurrent.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

8. Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

9. Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Site home page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this privacy policy to check for any changes.

10. Severability
If any term or condition of this Privacy Policy is deemed invalid or unenforceable by a court of law with binding authority, then the remaining terms and conditions shall not be affected, and the court shall reform the invalidated or unenforceable term or condition to the maximum extent permitted under the law and consistent with the intent of this Privacy Policy.
