CURRENT CLUB TERMS AND CONDITIONS

Welcome to the KC Current Current Club! By purchasing a Current Club Membership and/or accepting or using any of the benefits provided under a Current Club Membership (collectively, “Benefits”), you are agreeing to and accepting these Terms and Conditions.

PLEASE READ THE FOLLOWING TERMS CAREFULLY AS THEY GOVERN YOUR RIGHTS UNDER YOUR CURRENT CLUB MEMBERSHIP AND CONTAIN A BINDING, INDIVIDUAL ARBITRATION AND CLASS-ACTION WAIVER PROVISION BY WHICH YOU GIVE UP THE RIGHT TO FILE A LAWSUIT IN COURT INDIVIDUALLY OR AS PART OF A CLASS ACTION WITH RESPECT TO ANY DISPUTES RELATING TO THE CURRENT CLUB MEMBERSHIP.

I. MEMBERSHIP BENEFITS AND ELIGIBILITY.

Current Club Membership. As a Member of one of the following memberships (each, a “Current Club Membership”), you will receive the corresponding Benefits listed below:

Teal Current Club. Kansas City Current Season Ticket Members (each, a “Season Ticket Member”) are automatically enrolled in the Teal Current Club Membership and will receive the following Benefits each year in which they are a Season Ticket Member:

a ten percent (10%) discount on KC Current merchandise, early access to select KC Current online merchandise sales and exclusive in-store shopping days,
priority pre-sale access to purchase select KC Current home single match tickets and playoff tickets,
pre-sale access to tickets to select publicly ticketed events at CPKC Stadium and Current Club Member events,
early access to digital events and behind-the-scenes content from the KC Current,
one (1) Member gift as determined by KC Current in its sole discretion,
special offers from select KC Current corporate partners,
a digital Current Club Membership in-app badge,
a birthday greeting e-card, and
other Benefits as determined from time to time by KC Current in its sole discretion.

Red Current Club. Members who purchase a Red Current Club Membership for an annual fee of Fifty Dollars ($50.00) will receive the following Benefits each year of the membership:

a ten percent (10%) discount on KC Current merchandise, early access to select KC Current online merchandise sales and exclusive in-store shopping days,
priority access to available KC Current season tickets,
priority pre-sale access to purchase select KC Current home single game and playoff tickets,
pre-sale access to tickets to select publicly ticketed events at CPKC Stadium and Current Club Member events,
early access to digital events and behind-the-scenes content from the KC Current,
one (1) Member gift as determined by KC Current in its sole discretion,
special offers from select KC Current corporate partners,
a digital Current Club Membership in app-badge;
a birthday greeting e-card and
other Benefits as determined from time to time by KC Current in its sole discretion.

Current Kids. Members who purchase a Current Kids Membership for an annual fee of Twenty Dollars ($20.00) will receive the following Benefits on behalf of one (1) child under the age of eighteen (18) each year of the membership:

one (1) youth KC Current merchandise package (specific items to be determined by the KC Current in its sole discretion),
invitation to one (1) Current Kids special event at CPKC Stadium (timing and date to be determined by the KC Current in its sole discretion),
early access to digital events and behind-the-scenes content from the KC Current,
a digital Current Kids Membership card and/or in-app badge,
a birthday greeting e-card and
other Benefits as determined from time to time by KC Current in its sole discretion.

Member Eligibility. The purchaser of record of a Current Club Membership and/or the person who actually uses the Benefits (“Member” or “you”) must be an individual, living adult at least eighteen (18) years of age or a legal business entity. The Member must maintain a valid email address for the duration of the Current Club Membership.

Benefit-Specific Terms. The right to receive a Benefit is non-transferable and non-assignable. KC Current reserves the right to substitute a Benefit with one of comparable or greater value at its sole and absolute discretion. All costs and expenses associated with any acceptance and use of a Benefit not specified herein as being provided, including but not limited to shipping costs, transportation costs, parking, food and beverage, souvenirs, gratuities and other expenses incurred by accepting and making use of any Benefit, are the sole responsibility of the Member. To the extent any Benefit includes admission to an event at CPKC Stadium for a KC Current match or other event that requires the use of a ticket (a “Ticket”), the Kansas City Current Ticket Terms and Conditions then in effect shall apply to use of such Ticket. Pre-sale and priority ticket access is not guaranteed for every KC Current regular season or playoff match or other events taking place at CPKC Stadium and access to such match or Ticket inventory will be subject to availability. All purchases of KC Current merchandise are subject to such purchase terms and conditions then in effect, including the posted refund policy for items purchased online. Members are required to download the official KC Current mobile application on their smart phone for the use of certain Benefits. Benefits are provided on a rolling basis and some Benefits will not be available immediately upon purchase of a Current Club Membership. A Current Club Membership must be purchased at least ten (10) business days prior to a Member’s birthday in order receive any Benefits associated with the Member’s birthday.

II. AUTOMATIC RENEWAL.

Your Current Club Membership, including your commitment to make the payment associated with the applicable Current Club Membership, will automatically renew for one (1) additional year on January 1, 2027 upon the terms and conditions then in effect unless Member exercises its right to cancel its Current Club Membership as described below. Thereafter, the Current Club Membership will continue to automatically renew for an additional year each January 1st unless and until Member exercises its right to cancel its Current Club Membership as described below. The terms and conditions including the price of the Current Club Membership for the upcoming year, any updates to the Benefits and instructions for Member to cancel Member’s Current Club Membership will be provided to Member in a written renewal notice on or about November 1 each year. Member will be required to provide KC Current with notice of its intent to cancel its Current Club Membership for the upcoming year by the deadline specified in the renewal notice by emailing membership@kansascitycurrent.com (“Cancellation Notice”) or the Current Club Membership will automatically renew for the subsequent year with no further action required by Member or KC Current. Time is of the essence with respect to all dates specified in each renewal notice. If Member does not provide the Cancellation Notice within the opt-out window specified in the renewal notice, then the Current Club Membership shall continue for an additional year at the prices set forth in the renewal notice, and all payments will be charged automatically to Member’s Card in accordance with the dates set forth in the renewal notice. If Member affirmatively declines to repurchase/renew the Current Club Membership by exercising its right to cancel its Current Club Membership during the opt-out window, all of Member’s rights, titles and interest in and to the Benefits, shall terminate and be forfeited back to KC Current with no compensation to Member and no future obligation with respect to Benefits.

III. PAYMENT TERMS.

Payment by Card. Member understands that by purchasing a Current Club Membership, Member gives authorization to KC Current to charge the credit or debit card used to purchase such Current Club Membership (“Card”), including for any renewal year, in the requisite amount. Member warrants that Member has the authority to authorize charges to the Card for the purpose of paying for Current Club Membership and associated fees. KC Current is not liable in any way for erroneous billing statements or incorrect charges and that should such an error occur in billing, KC Current’s only responsibility is to correct it when and if KC Current receives notice of the error. There will be no refunds of any kind for these charges. KC Current reserves the right to restrict Benefits or revoke membership privileges and Benefits if any authorized charge is refused by the Card company or banking institution for any reason, including if Card information is not updated by Member. KC Current reserves the right to charge a processing fee in the event a charge to the Card is refused. Member is responsible for maintaining updated Card information for the duration of its Current Club Membership and will promptly notify KC Current of any updates to Card information and/or the Card on file.

KC CURRENT MEMBERSHIPS SALES ARE FINAL. NO REFUNDS, CREDITS OR EXCHANGES WILL BE PROVIDED EXCEPT AS PROVIDED HEREIN. Each Benefit, including the date and time such Benefit is provided, may be subject to change by KC Current in its sole discretion, and no such change shall entitle Member to a refund or credit. If a specific Benefit is unavailable for any reason, the sole and exclusive remedy is a substitute Benefit of equal or greater value as determined by KC Current in its sole and absolute discretion. No refund or remedy will be provided if a Current Club Membership is revoked for breach of this Agreement. Further, KC Current’s liability for breach of any term of these Terms and Conditions shall not exceed the annual purchase price of the applicable Current Club Membership. IN NO EVENT SHALL KC CURRENT OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE ANNUAL PURCHASE PRICE OF THE APPLICABLE CURRENT CLUB MEMBERSHIP.

IV. RELEASE, USE OF IMAGE AND DATA.

By purchasing a Current Club Membership or utilizing any of the Benefits, each Member agrees to release, defend, indemnify and hold harmless the KC Current, CPKC Stadium, and each of their parent(s), subsidiaries, affiliates, related entities, vendors, sponsors, officers, directors, partners, shareholders, owners, members, employees, agents, successors and assigns, whether past, present or future and whether in their institutional or personal capacities (collectively, the “Released Parties”) from and against any and all claims, injuries, damages or losses that may occur, directly or indirectly, in whole or in part, from your participation in the Current Club Membership or from the receipt and/or use of any Benefits. Each Member grants to each of the Released Parties an independent, royalty-free, perpetual, irrevocable, fully transferrable, non-exclusive, worldwide right (but not obligation) and license to publicize and use such Member’s name, address (city and state of residence), photograph, voice and/or other likeness in any and all media now known or hereafter devised, without additional compensation or consideration, notification or permission, unless prohibited by law. Any personally identifiable information collected during a Member’s purchase of a Current Club Membership or in connection with a Member’s attendance of an event provided as part of the Benefits will be collected by KC Current and used by KC Current (a) for purposes of proper administration and fulfillment of the Benefits as described in these Terms and Conditions and (b) as described in KC Current’s privacy policy, posted on the official KC Current website. By purchasing a Current Club Membership, you are agreeing to receive marketing and promotional emails from KC Current and its affiliates.

V. GENERAL TERMS.

Termination. KC Current may, without limiting any of its rights under this these Terms and Conditions, withhold distribution of Benefits and/or terminate a Current Club Membership immediately and automatically, without notice to Member if (1) Member fails to pay any amounts when due or fails to update its Card information, (2) Member and/or any member of Member’s party using a Benefit violates any terms, rules or laws applicable to use of a Benefit or the venue in which a Benefit is being provided, or (3) Member violates any other provision of these Terms and Conditions. The Teal Current Club Membership will terminate automatically and without notice if Member ceases to be a Season Ticket Member. The Current Kids Membership will terminate automatically and without notice upon the associated child’s eighteenth (18th) birthday. Upon termination of a Current Club Membership for any reason, Member’s rights to the Benefits will be revoked and Member will not be entitled to any refund, credit or other remedy. Termination of this Agreement will not limit the rights and remedies available to KC Current. KC Current may terminate this Agreement at any time by providing written notice to Member.

Arbitration and No Class Actions. Any dispute related to a Current Club Membership shall be resolved by mandatory, confidential, final, and binding arbitration held before a neutral, single arbitrator in Kansas City, MO conducted by the Judicial Arbitration Mediation Services, Inc. (“JAMS”) in accordance with the JAMS Comprehensive Arbitration Rules and Procedures then in effect. The costs of such arbitration shall be split evenly among the parties except upon an arbitrator’s finding that such split renders the arbitration cost-prohibitive to the Member. Any and all issues relating or pertaining to arbitration or this arbitration clause, including but not limited to the threshold question of arbitrability or the enforceability or validity of this arbitration clause shall be delegated exclusively to the arbitrator selected pursuant to this provision. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. MEMBER AND KC CURRENT AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO LITIGATE IN COURT OR BRING ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. IF MEMBER DOES NOT CONSENT TO THIS CLAUSE, MEMBER MUST NOT PURCHASE A MEMBERSHIP OR MUST DISCONTINUE USING ALL BENEFITS.

NOTICES. Any written notices to Member shall be sent to the email address on file on account. Any notices to KC Current should be sent via e-mail to: membership@kansascitycurrent.com.

MISCELLANEOUS. Except as expressly provided herein, Member may not assign or transfer its Current Club Membership and/or any Benefits, in whole or in part, under these Terms and Conditions without the express written consent of the KC Current, which may be withheld for any or no reason. Failure to enforce any provision of these Terms and Conditions by KC Current will not be a waiver or prevent enforcement of the same or any other provision of this Agreement. Other than any language appearing on the back of a Ticket related to a Benefit, any terms applicable to the purchase or acquisition of a Ticket, or the terms applicable to the purchase of KC Current merchandise, these Terms and Conditions form the entire understanding and agreement between the parties with regard to a Current Club Membership. KC Current may amend or supplement these Terms and Conditions as it deems necessary on an on-going basis without notice. By purchasing a Current Club Membership or by accepting and/or using a Benefit, Member is deemed to have read and agreed to the Terms and Conditions then in effect and is responsible for reading and complying with all information, revisions and amendments. KC Current is not responsible for problems, losses or inconveniences experienced because Member did not read updates to the Terms and Conditions of the Current Club Membership, or because information is sent to an incorrect email address due to Member’s failure to notify KC Current of any email address change. The titles of the articles, headings, sections, and subsections of these Terms and Conditions are for convenience only, and do not define or limit the contents. The provisions of these Terms and Conditions are severable, and the invalidity of one or more provisions herein shall not have any effect on the validity or enforcement of any other provision.
